EPA Proposes Adding More Chemicals to Toxics Release Inventory List

First program chemical expansion in more than a decade

WASHINGTON – The U.S. Environmental Protection Agency (EPA) is proposing to add 16 chemicals to the Toxics Release Inventory (TRI) list of reportable chemicals, the first expansion of the program in more than a decade. Established as part of the Emergency Planning and Community Right to Know Act (EPCRA), TRI is a publicly available EPA database that contains information on toxic chemical releases and waste management activities reported annually by certain industries as well as federal facilities. The proposal is part of Administrator Lisa P. Jackson’s ongoing efforts to provide communities with more complete information on chemicals.

EPA has concluded, based on a review of available studies, that these chemicals could cause cancer in people. The purpose of the proposed addition to TRI reporting requirements is to inform the public about chemical releases in their communities and to provide the government with information for research and potential development of regulations.

Four of the chemicals are being proposed for addition to TRI under the polycyclic aromatic compounds (PACs) category. The PACs category includes chemicals that are persistent, bioaccumulative, toxic (PBT) and are likely to remain in the environment for a very long time. These chemicals are not readily destroyed and may build up or accumulate in body tissue.

The TRI, established as part of the EPCRA of 1986, contains information on nearly 650 chemicals and chemical groups from about 22,000 industrial facilities in the U.S. Congress enacted EPCRA to provide the public with additional information on toxic chemicals in their communities.

EPA will accept public comments on the proposal for 60 days after it appears in the Federal Register.

Toxics Release Inventory Form A Eligibility Revisions

EPA is amending its regulations on the eligibility criteriafor submitting a Form A Certification Statement in lieu of the moredetailed Form R submitted by facilities subject to TRI reporting undersection 313 of the Emergency Planning and Community Right-to-Know Actof 1986 (EPCRA) and section 6607 of the Pollution Prevention Act of1990 (PPA). This action is being taken to comply with the ``OmnibusAppropriations Act of 2009'' enacted on March 11, 2009. As this actionis being taken to conform the regulations to a Congressionallegislative mandate, notice and comment rulemaking is unnecessary, andthis rule is effective immediately. Upon publication to the FederalRegister, the provisions of the Toxics Release Inventory BurdenReduction Final Rule will be removed and the regulations in place priorto its implementation will be restored as described below. DATES: This final rule is effective on April 27, 2009. (More....)

2007 TRI Reporting Data Available

The following is an update from EPA's Superfund, TRI, EPCRA, RMP & Oil Information Center:

On March 19, 2009, EPA made available the most recent reporting data from the Toxics Release Inventory (TRI) Program. The Reporting Year 2007 (RY07) TRI public data release (PDR) included information on the combined releases of four billion pounds from approximately 22,000 facilities. TRI's 2007 PDR includes a brochure with a quick overview of the 2007 data with a general comparison to previous years' trends, as well as a detailed report outlining the key findings. Information about TRI's 2007 PDR, including a copy of the report, is available at the following URL: www.epa.gov/tri/tridata/tri07 For additional questions about the TRI 2007 PDR or TRI regulatory requirements, please contact the Superfund, TRI, EPCRA, RMP & Oil Information Center at: (800) 424-9346 -- Toll Free(703) 412-9180 -- Metropolitan DC area and international calls(800) 553-7672 -- Toll Free TDD(703) 412-3323 -- Metropolitan DC area and international TDD To speak with an Information Specialist, please call between 10:00 AM and 3:00 PM, Monday through Thursday, Eastern Standard Time.

EPA Releases 2007 TRI Data Using the Electronic Facility Data Release (e-FDR)

Contact: Suzanne Ackerman, (202) 564-4355 / ackerman.suzanne@epa.gov

To better inform communities about releases of toxic chemicals from industrial facilities in their area, EPA today announced the availability of the Toxics Release Inventory (TRI) facility-level data for 2007. This is the 5th annual Electronic Facility Data Release (e-FDR) and displays the TRI data exactly as received by EPA from the facilities - one form for each chemical at a facility. Many stakeholders have requested that EPA share TRI data sooner and in the format received, without waiting for further analysis. The "raw" data released today are not grouped in any way or are as easily searchable as the traditional Public Data Release (PDR), which also includes more quality checks, national trends and analysis. EPA will still publish the complete 2007 PDR in early 2009.

TRI provides American communities with vital information on chemical releases including disposal of chemicals. In addition, TRI tracks releases of chemicals and industrial sectors specified by the Emergency Planning and Community Right to Know Act of 1986. The Pollution Prevention Act of 1990 also mandates that facilities report data on other waste management activities such as treatment, recycling, and energy recovery. The e-FDR is now available at: http://www.epa.gov/tri-efdr
